CONSUMER TERMS ANDS CONDITIONS OF SALE
(Terms and Conditions for Businesses)
1. Application
1.1 These Terms apply where the Customer is acting as a consumer and is purchasing Goods wholly or mainly for personal use.
1.2 These Terms do not apply to business customers. Business customers are subject to the Company's Business Terms and Conditions of Sale.
2. Definitions
Company means Euro-Bearings Limited.
Consumer means an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
Goods means the products supplied by the Company.
Contract means the agreement between the Consumer and the Company for the purchase of Goods.
3. Orders and Contract Formation
3.1 Orders placed by the Consumer constitute an offer to purchase Goods.
3.2 Acceptance occurs when the Company issues an order confirmation or dispatches the Goods.
3.3 The Company reserves the right to reject any order prior to acceptance.
4. Product Information
4.1 Product descriptions, images and specifications are provided for general guidance only.
4.2 Minor variations that do not materially affect performance may occur.
4.3 The Consumer remains responsible for ensuring that Goods are suitable for the intended application.
4.4 Technical advice or recommendations given by the Company are provided in good faith but shall not create any warranty or guarantee.
5. Price and Payment
5.1 Prices exclude VAT unless stated.
5.2 Delivery charges will be displayed separately before checkout.
5.3 Payment must be received in full before dispatch unless otherwise agreed.
6. Delivery
6.1 Delivery dates are estimates only.
6.2 The Company will use reasonable efforts to deliver within the stated timescale.
6.3 Risk passes to the Consumer upon delivery of the Goods.
6.4 Ownership of the Goods passes upon receipt of full payment.
7. Consumer Right to Cancel
7.1 For distance sales, the Consumer has the right to cancel the Contract within 14 days without giving any reason.
7.2 The cancellation period expires 14 days after the day on which the Consumer receives the Goods.
7.3 To exercise the right to cancel, the Consumer must notify the Company by email or in writing before the expiry of the cancellation period.
7.4 The Consumer shall return the Goods within 14 days of cancellation.
7.5 The Consumer shall be responsible for the direct cost of returning the Goods unless otherwise required by law.
8. Non-Cancellable and Non-Returnable Goods
8.1 The statutory right to cancel does not apply to Goods:
(a) manufactured or cut to the Consumer's specifications;
(b) clearly personalised for the Consumer;
(c) modified or assembled specifically to meet the Consumer's requirements;
(d) specially sourced or produced specifically for the Consumer where an exemption under applicable consumer legislation applies.
8.2 Such Goods shall be identified by the Company before the order is accepted.
8.3 Once an order for such Goods has been accepted, the Consumer shall not have a right to cancel solely because they have changed their mind.
8.4 Nothing in this clause affects the Consumer's legal rights where Goods are faulty, not as described, or otherwise fail to comply with applicable consumer legislation.
9. Returns
9.1 Returned Goods must be:
(a) unused except to the extent necessary to inspect them;
(b) complete;
(c) returned with original packaging where reasonably possible.
9.2 The Company may make a deduction from any refund where the value of the Goods has been diminished through handling beyond what is necessary to establish their nature, characteristics and functioning.
10. Refunds
10.1 Refunds due following cancellation will be made within 14 days of:
(a) receipt of the returned Goods; or
(b) evidence of return being provided,
whichever occurs first.
10.2 Refunds will be made using the original payment method unless otherwise agreed.
11. Faulty Goods
11.1 Consumers have statutory rights under the Consumer Rights Act 2015.
11.2 Nothing in these Terms limits or excludes those rights.
11.3 Where Goods are faulty, not as described, or not of satisfactory quality, the Consumer may be entitled to repair, replacement, price reduction or refund in accordance with applicable law.
12. Warranty Exclusions
12.1 The Company shall not be responsible for faults arising from:
(a) misuse;
(b) incorrect installation;
(c) inadequate lubrication;
(d) contamination;
(e) overloading;
(f) accidental damage;
(g) modification or repair by third parties;
(h) normal wear and tear.
12.2 This clause does not affect the Consumer's statutory rights.
13. Limitation of Liability
13.1 Nothing in these Terms excludes or limits liability for:
(a) death or personal injury caused by negligence;
(b) fraud or fraudulent misrepresentation;
(c) any liability which cannot lawfully be excluded.
13.2 Subject to clause 13.1, the Company's liability shall be limited to losses that are reasonably foreseeable.
13.3 The Company shall not be liable for losses arising from commercial use of the Goods.
14. Data Protection
The Company will process personal information in accordance with applicable data protection legislation and its Privacy Policy.
15. Force Majeure
The Company shall not be liable for delay or failure caused by circumstances beyond its reasonable control.
16. Governing Law
These Terms shall be governed by the laws of England and Wales.
Consumers may bring proceedings in the courts of England and Wales or in any other court having jurisdiction under applicable consumer protection legislation.
